Introduction

Welcome to Salia. By creating an account or using our service, you agree to be bound by these Terms and Conditions. Please read them carefully before using Salia. If you do not agree with any part of these terms, you may not use our service.

Definitions

In these Terms and Conditions:

"Service"

– The Salia platform, including the website, application, and all related features.

"User"

– Any person or entity that accesses or uses the Service.

"Customer"

– A business owner who creates an account on Salia to manage referral and loyalty programs.

"Referrer"

– An existing customer of the Customer who receives a referral code to share.

"Friend"

– A person who receives a referral code from a Referrer and may use it to access special offers.

"Account"

– The Customer's account on Salia, created through Google OAuth or magic link authentication.

Scope of the Service

Salia provides tools to help business owners manage referral and loyalty programs through codes. The Service allows Customers to:

• Create and manage referral codes for their existing customers
• Set up special offers for referrers and their friends
• Track which referrers bring which friends
• Monitor code usage and estimated revenue generated

Account & Eligibility

Salia is designed for business owners (B2B). By creating an account, you represent that:

• You are a business owner or authorised representative of a business
• You are at least 18 years old or the legal age of majority in your jurisdiction
• The information you provide is accurate and complete
• You will keep your account credentials secure and confidential
• You are responsible for all activities that occur under your account

Use of the Service

When using Salia, you agree to the following:

Payments & Billing

Salia offers subscription plans with different features and limits. Payment processing is handled securely through Stripe.

• Subscriptions are billed on a recurring basis (monthly or annually)
• Prices are displayed in your account and may vary by plan
• You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• Refunds may be provided at our discretion for unused portions of subscriptions
• We reserve the right to modify pricing with reasonable notice

Data & Privacy

Your use of Salia is also governed by our Privacy Policy. Regarding data responsibilities:

• You are the data controller for the personal data of your referrers and friends
• Salia acts as a data processor on your behalf for this data
• You are responsible for obtaining necessary consents from your referrers and friends
• Salia may use anonymised and aggregated data to improve the Service
• You must comply with all applicable data protection laws when using Salia

Availability & Support

We make reasonable efforts to maintain the availability and performance of Salia. However, we do not guarantee uninterrupted or error-free service. Scheduled maintenance, updates, and unforeseen issues may occasionally affect availability. Support is provided on a best-effort basis via email at contact@salia.io.

Intellectual Property

Regarding intellectual property rights:

• Salia and its licensors retain all rights to the platform, brand, design, and technology
• You retain all rights to your business data, content, and offers created on the platform
• You grant Salia a limited licence to display and process your content as necessary to provide the Service
• You may not copy, modify, or reverse-engineer any part of the Service

Limitation of Liability

To the maximum extent permitted by law, Salia's liability is limited as follows:

• Salia does not guarantee specific results (e.g., more customers or revenue)
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the fees you paid to Salia in the 12 months preceding the claim
• You agree to indemnify Salia against claims arising from your use of the Service or violation of these terms

Termination

Regarding account termination:

• You may terminate your account at any time through your account settings or by contacting us
• We may suspend or terminate your account for violation of these terms or for any other reason with reasonable notice
• Upon termination, your access to the Service will cease
• We may retain certain data as required by law or for legitimate business purposes
• Provisions that by their nature should survive termination will remain in effect

Governing Law & Jurisdiction

These Terms and Conditions are governed by Swiss law. Any disputes arising from or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts of Switzerland. This choice of law does not deprive you of mandatory consumer protections available under your local law, if applicable.
